CE Marking is a process that allows manufacturers to declare that their product complies with all applicable European Community Directives. A declaration of conformity, issued by the manufacturer or its authorised representative, allows the product to be marked with the CE mark and offered for sale in the EU. Machinery may not be offered for sale in the EU without CE marking unless it falls within one of the Machinery Directive exclusion categories [ PDF 529 kB ]. CE marking according to the requirements of the Machinery Directive is mandatory for machines offered for sale in the European Union.
The majority of the directives that require CE marking cover the safety of the product. In the case of machinery, the principal directive is the Machinery directive (98/37/EC [ PDF 397 kB ] & 2006/42/EC [ PDF 1401 kB ]). Since many machines contain electrical components or functions, two other directives commonly apply to machinery, namely the Low Voltage Directive [ PDF 431 kB ] and the EMC directive [ PDF 1602 kB ]. Both of these directives contain additional requirements, which must be satisfied before CE marking can be applied. The CE marking process is often relatively simple, but requires an interpretation of the requirements of the directives applicable to the product to be marked and, in the case of the machinery directive, a risk assessment [ PDF 308 kB ] against the applicable Essential Health and Safety Requirements.
The manufacturer, or their authorised representative in the EU, should declare compliance of the product to the requirements of the applicable directives before placing the CE mark on it and, in so doing, takes legal responsibility for the product. It is therefore important to have some documentary evidence of having interpreted the requirements of the relevant directives and evidence of testing to demonstrate conformity with these requirements.
